In many countries around the globe, gay and lesbian couples are seeking the right to marry or enter into other legally recognized forms of domestic partnerships. The legal definition of marriage is in flux, particularly in the developed world, as governments re-examine what long seemed to be a well-established aspect of civil law.

A study released by the European Commission in 2006 found that a plurality of people in the European Union (49%) oppose gay marriage. Yet, as in the United States, the public remains divided on the issue, with 44% favoring same-sex marriage. Approval rates in individual European countries vary greatly. In socially progressive Holland, for instance, 82% of all adults favor allowing same-sex marriage; in heavily Roman Catholic Poland, only 17% of adults support gay marriage.

In USA many state laws recognises same sex marriage and it has started with whims and fancy.

US President Barack Obama has extended partial federal partners to the same sex partners of US government workers, in what he said was a historic step towards equality for gays and lesbians. "Many of our government's hardworking and dedicated patriotic public servants have long been denied basic rights that their colleagues enjoy - for one simple reason, the people that they love are of the same sex,"said Mr.Obama upon signing a presidential memorandum ushering in the changes.

Under the changes, domestic partners can be covered by the government's long-term insurance program for illnesses such as Alzheimer's disease. The move also allows employees to use sick leave to care for an ill partner or non-biological child, and lets the same-sex partners of diplomats use medical facilities at foreign postings.

The move will also cover members of the Foreign Service, allowing partners of diplomats to use medical facilities at U.S. post abroad, to benefit from medical evacuations and to be included in housing allocations. However, the president's order fell short of offering survivor benefits or comprehensive healthcare, drawing sharp criticism from within the gay community.

The 1996 Defense of Marriage Act, which bans the federal government from recognizing same-sex marriage, prevents more generous benefits for same-sex partners.Obama strongly supported gay rights during his presidential campaign. But he has outraged gay activists since then by failing to fight for two of their priorities: repealing the Defense of Marriage Act, and ending the military's "don't ask, don't tell" policy, which forbids gays and lesbians to serve openly in the military.

The president seemed to address those frustrations , saying his action "is only one step." He endorsed legislation that would extend the full range of benefits to domestic partners of federal workers and reiterated his opposition to the federal marriage law, calling it discriminatory and vowing to "work with Congress to overturn it."

Despite Mr.Obama's action on this memorandum, the President is yet to follow through on a White House promise to end the ban on gays serving openly in U.S. military. Also Eric Bauman, a gay activist and vice chairman of the California Democratic Party said "For the first time, we've seen a president recognizing and acknowledging in an affirmative same-sex couples."

In a breakthrough judgment, the Delhi High Court, reviewed a law that prohibits gay sex and on Thursday, July 2, 2009, ruled that homosexual intercourse between consenting adults is not a criminal act. The court ruling decriminalizes homosexuality in the Indian capital, a decision that could bring more freedom for gays in this deeply conservative country. The Delhi High Court ruled that treating consensual gay sex as a crime is a violation of fundamental rights protected by India's constitution. The ruling, the first of its kind in India, applies only in New Delhi.

The court's verdict came more than eight years after the New Delhi-based foundation, Naz Foundation (India) Trust filed its petition . The verdict can be challenged in India's Supreme Court.
Section 377 of the Indian Penal Code, sanctions discrimination and marginalizes the gay community. Homosexuality is gradually being accepted in some parts of India, especially in the metros. Gay nights are celebrated in many across the country. Many high-profile Indians including Bollywood stars have acknowledged the same.
But the ruling has raised a hue and cry in other areas like religion. Many religious leaders have come out openly against this ruling.

I don't agree in marriage with the same sex, marriage wasn't for same sex it's for a man and women. If anyone chooses to be with the same sex then so be it it's your life but, to get married is morally inappropriate.

I totally agree with jolix, marriage is sacred between a man and a woman. I understand that not all people fall in love with the opposite sex and that's fine too but, to want to have the right to get married is wrong.
